An EIN, if you need one, takes minutes online. Oklahoma then adds a sales tax permit if you sell taxable goods, withholding if you have employees, and an unemployment account once you owe the tax.
What’s different in Oklahoma
- Sales tax is 4.5%1 plus the local rate at the place the customer receives the goods. Food and food ingredients are 0%2 for the state portion. Two Tax Commission pages name different start dates for that change.
- Individual income tax is due April 15, or April 20 when the return is filed electronically, and the payment that day also has to be electronic4.
- Franchise tax returns ended after tax year 2023. Details are on Stay compliant.
- Unemployment tax for 2026 uses a $25,00011 wage base. For calendar year 2027, it is $24,40010.
Do this
- Get an EIN from the IRS if you need one. It is free and, if approved, issued immediately14 online. The commerce licenses page says a sales tax permit starts with the Secretary of State filing number and an EIN8. A sole proprietor who has not filed a trade name may not have a Secretary of State number.* Check the OkTAP questions before you assume you are blocked. Don’t pay a website to apply for the EIN.
- Register for sales tax with the Oklahoma Tax Commission if you sell taxable goods on an ongoing basis. A permit is for someone selling tangible personal property for consideration on an ongoing basis. There is no permit for an occasional sale. File a report only when a sale is made, and mark it casual. The commerce page prices the permit at $208 plus a handling fee. It does not state the handling amount.* Check the total on OkTAP. A remote seller registers after $100,000 in Oklahoma taxable sales in the preceding or current calendar year. A marketplace facilitator with more than $10,000 in taxable Oklahoma sales in the prior 12 months has to collect the tax, or follow the notice and reporting rules, once the threshold is met3. Sales the platform collects can still leave you with tax on sales you make yourself.
- Charge the rate for the place the customer receives the goods. That is the place of business, when the customer receives the goods there, or the place the customer receives the goods, when you deliver them. The state piece is 4.5%, and the city or county rate is added when that place has one1. Check the rate for that place on the Tax Commission’s sales tax materials before you charge one from memory.
- File sales tax on the 20th unless the commission assigns another schedule. File and pay through OkTAP. Most permit holders remit by the 20th of the next month. The law allows filing twice a year when the tax remitted does not exceed 50 dollars a month, due July 20 for January through June, and January 20 for July through December. The commission requires electronic filing when returns average 2,500 dollars or more a month. A report is due the next business day when the due date is a Saturday, Sunday or observed state holiday. A late business tax adds 10% of the tax, and interest of 1.25%3 a month.
- Register for withholding when you pay wages in Oklahoma. Start on OkTAP. You remit quarterly when you withhold less than 500 dollars in a quarter, on the federal semi-weekly schedule, if that is the federal schedule you follow, or monthly for everyone else. Tax is not withheld on payments to independent contractors3. The help center does not print a separate due day for the monthly and semi-weekly payments.* Use the date OkTAP shows.
- Open an unemployment account when you are liable. The test is $1,500 of wages in a quarter, or an employee in 20 weeks of the year. Agricultural employers, domestic employers and some nonprofits have additional rules9. Register in the OESC Employer Portal. You file a quarterly report on every active account, even when no wages were paid15. Under OAC 240:10-5-91, quarterly wage reports and unemployment contributions are due the last day of the month after the quarter (April 30, July 31, October 31 or January 31)13. File and pay through the OESC Employer Portal. A missed report draws a notice, and the penalty follows that notice. For 2026 the wage base is $25,000 and rates run from 0.2% to 5.8%11. A new employer pays 1.5%, until the employer has at least four quarters of history in a rate cycle. For calendar year 2027, the rates page lists a wage base of $24,400 and rates from 0.1% to 5.5%10.
- Report every new hire. Report them to the Employment Security Commission within 20 days of the start date. On a recall, report the employee again, marked recalled, using the return-to-work date after the layoff ends12. The hiring guide covers the federal side.
Rates and income tax
General sales tax is 4.5%1 statewide, plus local tax where the city or county levies one. The rate follows the place the customer receives the goods.
Food and food ingredients are 0% for the state portion, and local sales and use tax still applies. The Tax Commission says prepared food, alcoholic beverages and dietary supplements stay at the full state rate. The food page dates the exemption August 29, 2024. The help center dates it August 30, 2024, and its reporting note says to collect state tax on food and food ingredients for August 1 through 29, then stop3.* For a business opening now, the exemption is already in effect on either date. If a return still covers late August 2024, follow the help center’s split and confirm it. Food you prepare at home is most often treated as prepared food, so not eligible for the zero state rate2.
Individual income tax, for owners who report the business on their own return: for tax year 2026, no tax on the first 3,750 dollars, then graduated, up to 109.25 dollars plus 4.5 percent of income over 7,200 dollars. Married filing jointly: for tax year 2026, no tax on the first 7,500 dollars, then graduated, up to 218.50 dollars plus 4.5 percent of income over 14,400 dollars. The report says head of household uses the married brackets. The top rate in that report is 4.5%6. File by April 15, or April 20 when the return is filed electronically, and the payment that day also has to be electronic4. The report does not print every bracket between the zero band and the top.* Use the Form 511 instructions for the year you are filing if you need the middle bands.
A C corporation pays 4% and files no later than 30 days after the federal due date. To extend, use Form 504-C when Oklahoma tax is owed or the federal return is not extended. A federal extension covers Oklahoma only when no Oklahoma tax is owed. An extension to file is not an extension to pay, and 90 percent of the tax has to be paid by the original due date3. An S corporation is not taxed by Oklahoma on income allocated to a resident shareholder. A nonresident shareholder's share is taxed at the corporation unless Form 512-SA was filed with the original return5.
A pass-through entity, including a partnership and an LLC that is not taxed as a corporation, files on the same rule: no later than 30 days after the federal due date5. The entity can elect to pay Oklahoma income tax itself. For tax year 2026 the developer specifications say the rate is 4.5% on income allocated to individual and trust owners, and 4%7 on income allocated to corporate, S corporation and partnership owners. The election is made on Form 586 by itself, or on OkTAP, no later than two months and 15 days after the year begins. Starting with tax year 2024 it can also go with the timely return, extensions included3. Whether the election helps depends on your numbers. Ask a CPA. This page does not pick it for you.
For nonresident owners, tax is withheld on distributions to individual nonresident members, unless the member has given you Form OW-15. Withholding is not required for members of an electing pass-through entity3.
What you get back
An EIN from the IRS, a sales tax permit if you registered, a withholding account if you have employees, and an unemployment account once you are liable. Write down the sales tax schedule the commission assigns. The 20th is the usual date, not a date you choose.
Common questions
Does Oklahoma have sales tax?
Yes. The state rate is 4.5%, and the city or county rate is added where that place has one. Food and food ingredients are 0% at the state level. Local tax still applies. Prepared food stays at the full state rate.
How much does an Oklahoma sales tax permit cost?
The commerce licenses page says $20 plus a handling fee. It does not state the handling amount. You register on OkTAP.
